About Flowly People

Flowly People is a trading name of DoArt, a sole proprietorship (eenmanszaak) registered in the Netherlands with the Dutch Chamber of Commerce (Kamer van Koophandel) under KVK number 58598464, with its principal place of business in Helmond, Netherlands.

Flowly People operates the website at flowlypeople.com and provides a proprietary white-label digital lead capture and profile platform designed for real estate agencies and professionals (the "Platform").

When these Terms refer to "Flowly People", "we", "us" or "our", they mean DoArt trading as Flowly People. When they refer to "you" or "your", they mean the individual or business entity accessing or using the Platform.


Who Can Use the Platform

The Platform is available to the following categories of users:

  • Real estate agencies and brokerages — businesses that wish to subscribe to the Platform on behalf of their agents and team;

  • Individual real estate agents and professionals — individuals acting in the course of their professional activity.

By using the Platform, you confirm that:

  • You are at least 18 years of age;

  • If you are signing up on behalf of a business, you have the authority to bind that business to these Terms;

  • You are using the Platform for professional or business purposes, not for personal, household, or consumer purposes;

  • The information you provide during registration is accurate, current, and complete.

The Platform and Services

Flowly People provides the following services (together, the "Services"):

  • A white-label digital profile page for each of your real estate agents, shareable via QR code, Apple Wallet link, and NFC card tap;

  • A bilateral contact exchange feature that automatically captures prospect contact details and stores them in the Platform dashboard;

  • An admin dashboard showing per-agent interaction statistics, lead history, and CSV export functionality;

  • Optional CRM integration via Zapier (subject to the conditions in Section 6);

  • Onboarding setup including a custom-branded agency dashboard, agent profile templates, and a live onboarding call;

  • Ongoing platform maintenance and automatic updates.

Delivery and timelines

Flowly People will use commercially reasonable efforts to deliver onboarding and make the Platform live for your agency as quickly as possible. However, no specific go-live date or delivery timeline is guaranteed. Setup time depends on the complexity of your requirements, the speed with which you provide required information and assets, and third-party platform availability. Delays caused by your failure to provide required information, or caused by third-party services outside our control, are not our responsibility.

Platform availability

We aim to maintain Platform availability of 99% measured on a monthly basis. However, we do not guarantee uninterrupted or error-free access at all times. The Platform may be unavailable during scheduled maintenance windows (for which we will give at least 24 hours' notice where practicable), Force Majeure Events, or due to downtime caused by third-party infrastructure providers. We are not responsible for the availability or reliability of third-party services that the Platform depends on.

Service modifications

We reserve the right to modify, update, or discontinue features of the Platform at any time, provided that we will not materially reduce the core functionality of your subscribed plan during an active subscription period without reasonable notice.

Accounts and Registration

To use the Platform, you must enter into a signed Service Agreement with Flowly People. Your account is created upon execution of that Agreement and clearance of your first payment.

You are responsible for:

  • Maintaining the confidentiality of your account credentials and admin dashboard login details;

  • All activity that occurs under your account;

  • Notifying us immediately at info@flowlypeople.com if you become aware of any unauthorised access to your account;

  • Keeping your contact information and payment details up to date.

You may not share your account credentials with unauthorised persons or allow third parties to use your account on your behalf without our prior written consent.

Subscriptions and Payment

Pricing plans

The Platform is available on the following subscription plans:

Starter: Up to 5 agents — $590 / month or $5,900 / year

Growth:Up to 10 agents — $790 / month or $7,900 / year

Agency: Up to 20 agents — $1,090 / month or $10,900 / year

All fees are stated in US Dollars (USD) and are exclusive of applicable taxes. The specific plan and fee applicable to you are set out in your signed Service Agreement.

Minimum commitment

All subscriptions are subject to a minimum non-cancellable term of ninety (90) calendar days from the contract start date. You may not cancel, suspend, or request a refund during this period for any reason. This minimum term reflects Flowly People's upfront investment in your onboarding at no setup fee to you.

Automatic billing

Subscription fees are charged automatically via Stripe on the billing cycle date stated in your Service Agreement. By subscribing, you authorise Stripe to charge your registered payment method on each due date without further action from you.

Non-refundable first month

The first month's subscription fee is non-refundable in all circumstances, except in the event of a material service failure by Flowly People as defined in your Service Agreement. This reflects the irrecoverable costs of onboarding, platform configuration, and third-party seat licences incurred by Flowly People on your behalf.

After the minimum term

After the minimum term, your subscription continues on a rolling monthly or annual basis (as selected) and may be cancelled by either party with 30 days' written notice by email. Termination takes effect at the end of the billing period following the notice period.

Price changes

We may increase subscription fees for non-Founding Agency clients with 60 days' prior written notice. If you have been designated a Founding Agency in your Service Agreement, your subscription fee is permanently locked at the rate stated in that Agreement and is not subject to price increases.

Failed payments

If your payment fails, we will notify you by email and retry the charge up to 4 times within 7 days. If payment is not resolved within 7 days of our notification, we may suspend your access to the Platform. All payment obligations continue during any suspension period. Your access will be restored within 1 Business Day of confirmed receipt of all outstanding amounts.

NFC cards

NFC cards are an optional physical product available at $45.00 per card with a minimum order of 5 cards ($225.00 minimum). NFC card orders are separate one-off purchases governed by a separate order confirmation. NFC card payments are non-refundable once production commences. Estimated delivery is 10–14 Business Days from order confirmation. We are not liable for carrier delays once cards have been dispatched.

CRM Integration and Zapier

CRM integration is an optional feature offered at no additional charge. Flowly People integrates exclusively via Zapier. We do not support direct API integrations or any integration method other than Zapier.

The following conditions apply to CRM integration:

  • Compatibility requirement: CRM integration is only possible if your CRM is compatible with Zapier. We have no obligation to provide an alternative integration method if your CRM is not Zapier-compatible.

  • Your Zapier account: You are solely responsible for creating, maintaining, and paying for an active Zapier account with sufficient task allowance to support the integration. All Zapier subscription fees and task costs are your responsibility. Flowly People does not pay for, subsidise, or reimburse any Zapier costs.

  • Account access: You grant us temporary access to your Zapier account for the sole purpose of configuring the integration. We will not use this access for any other purpose.

  • No guarantee: We will assist with configuring the Zapier connection on a best-efforts basis but cannot guarantee that integration will be successfully completed, as this depends on your CRM and Zapier's platform functionality.

  • Not a service failure: If your CRM is not compatible with Zapier, or if CRM integration fails for any reason outside our control, this does not constitute a failure of service and is not grounds for cancellation or refund. All lead data remains accessible in the Platform dashboard and can be exported as a CSV at any time.

  • Ongoing sync: You are responsible for monitoring the integration and notifying us of any sync failures. We do not monitor Zapier sync status on an ongoing basis.

Acceptable Use

You may use the Platform only for lawful purposes and in accordance with these Terms. You agree not to use the Platform:

  • For any purpose that is unlawful or prohibited by applicable law or regulation;

  • To collect personal data of individuals under the age of 18;

  • To send unsolicited commercial communications (spam) to any contacts captured through the Platform;

  • To circumvent, disable, or interfere with any security feature of the Platform;

  • To reverse-engineer, decompile, disassemble, or attempt to derive the source code or underlying technology of the Platform;

  • To attempt to identify, contact, or contract directly with any third-party technology providers used by Flowly People to power the Platform;

  • To upload or transmit any content that is defamatory, obscene, fraudulent, or otherwise objectionable;

  • In any manner that could damage, disable, overburden, or impair the Platform or interfere with any other user's use of the Platform;

  • To misrepresent your identity or affiliation, or to impersonate any person or entity.

Violation of this Section constitutes a material breach of these Terms and your Service Agreement, and may result in immediate suspension or termination of your account without refund.

Intellectual Property

Our intellectual property

The Platform and all content, features, functionality, software, algorithms, processes, documentation, and know-how forming part of it are owned by Flowly People and/or our licensors and are protected by intellectual property laws. You receive only a limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Platform during your subscription solely for your own internal business purposes. No other rights are granted.

The identity of any third-party technology providers used by Flowly People to power the Platform constitutes confidential information of Flowly People. You will not disclose, publish, or share this information with any third party.

Your content and branding

You retain ownership of all content you upload to the Platform, including your agency logo, branding, agent information, and listings. You grant Flowly People a limited, royalty-free licence to use your logo and branding solely for the purpose of configuring and operating your branded dashboard and agent profiles. This licence ends automatically when your subscription is terminated.

Feedback

If you submit suggestions, ideas, or feedback about the Platform, you grant Flowly People a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without restriction or compensation to you.

Your Data

You retain all rights as Controller (as defined under the GDPR) of the lead data and prospect contact information captured through the Platform. Flowly People processes that data as your Processor, solely in order to provide the Services.

You are solely responsible for:

  • Ensuring you have a lawful basis under applicable data protection law for collecting prospect contact data through the bilateral exchange feature;

  • Providing appropriate privacy notices to prospects at the point of data capture;

  • Maintaining a privacy policy on your own website that accurately describes your use of the Platform for lead capture purposes;

  • Responding to data subject rights requests from your prospects.

Our obligations as your data Processor, and the details of our data processing activities, are set out in your Service Agreement (Schedule B — Data Processing Summary) and our Privacy Policy.

Upon termination of your subscription, you may request a CSV export of all lead data captured through the Platform. We will provide this within 10 Business Days of your written request. After 30 days post-termination, we may permanently delete your data from our systems.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Platform is provided "as is" and "as available" without any warranties of any kind, whether express or implied. Flowly People expressly disclaims all implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, Flowly People does not warrant that:

  • The Platform will be uninterrupted, error-free, or free from security vulnerabilities at all times;

  • CRM integration will be achievable for any particular CRM system;

  • Any specific delivery or go-live timeline will be met;

  • Any specific business results, lead capture rates, or conversion outcomes will be achieved through use of the Platform;

  • The Platform will be compatible with all devices, browsers, or operating systems.

You acknowledge that lead capture outcomes depend on agent behaviour, prospect actions, and market conditions entirely outside our control.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • Flowly People's total aggregate liability to you under or in connection with these Terms or your use of the Platform shall not exceed the total subscription fees you have paid to Flowly People in the three (3) calendar months immediately preceding the event giving rise to the claim;

  • Flowly People shall not be liable for any loss of profits, loss of revenue, loss of business, loss of data (beyond the data export obligation described in Section 9), loss of anticipated savings, loss of goodwill, or any indirect, incidental, special, consequential, or punitive damages — whether or not we were advised of the possibility of such losses;

  • Flowly People shall not be liable for any losses arising from failure to achieve CRM integration, Zapier unavailability or incompatibility, or the acts or omissions of third-party providers.

Nothing in these Terms limits or excludes liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; wilful misconduct; infringement of intellectual property rights; or any other liability that cannot be excluded or limited under applicable law.

Termination

Termination by you

You may terminate your subscription after the minimum commitment period by providing 30 days' written notice by email to info@flowlypeople.com. Termination takes effect at the end of the billing period following the notice period. No refunds are issued for any remaining period within a billing cycle.

Termination by us

We may suspend or terminate your access to the Platform immediately if:

  • You fail to make payment when due and the failure continues for 14 days after our written demand;

  • You materially breach these Terms or your Service Agreement and fail to remedy the breach within 14 days of written notice;

  • You become insolvent, enter into administration, or cease to trade;

  • You use the Platform for an unlawful purpose or in violation of Section 7 (Acceptable Use).

Effect of termination

On termination for any reason: all outstanding subscription fees become immediately due and payable; your access to the Platform will be disabled within 2 Business Days; and Sections 7, 8, 9 (data export rights), 10, 11, and 14 of these Terms survive termination.

Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. When we make material changes, we will notify you by email at least 30 days before the changes take effect.

Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you may terminate your subscription in accordance with Section 12.

The date at the top of this page always shows when these Terms were last updated.

Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. The parties expressly exclude the application of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts of Oost-Brabant, Netherlands.

Before commencing legal proceedings, we ask that you contact us at info@flowlypeople.com to allow us 21 days to resolve the dispute in good faith. This does not prevent either party from seeking urgent injunctive or other interim relief where necessary.
